Critical Issues for Expert Advice:

  – European Union Data Protection Directive is the model for POPI.  Many of its guidelines will probably be applied by the POPI Regulator.  

- Rules ‘most advantageous to the consumer’ – what does this mean in terms of the Impacts on the Promotion of Access to Information Act (2000) and the Electronic Communications & Transactions Act 2002, and The Consumer Protection Act (2012).

- ‘Legitimate interests’ allows exemptions for companies but not defined, the EU Directive does define and we will discuss.

- Consent and Purpose. EU Directive Guidelines will probably apply, vital implications for marketers .

- Stating purpose will help marketers achieve consent but how will it be applied in practice.

- Unsolicited Electronic Communications, email, SMS, fax etc.  Understanding the constraints and the sensible guidelines to follow.

- Social Media how will corporate communications via social media be impacted.

- Data collections and integration, derived insights and profiling, how will these be affected.

- Personal Information must be collected for a specific, explicitly defined and lawful purpose. 

- Critical to appreciate the constraints and intents of POPI.

- The Reguator, his powers and penalties.

- Marketing practices most likely to be affected e.g. cross selling
